BACKGROUND OF THE OVERTIME ACTION
As set forth in the Notice, this lawsuit was brought on behalf of current and former claims adjusters (a/k/a claims evaluators) who worked for Worley Catastrophe Response, LLC, and/or Worley Catastrophe Services, LLC (collectively “Worley”) on the project commonly known as the BP Oil Spill that occurred in 2010. On February 4, 2011, Lead Plaintiff John J. Altier (“Altier”) filed a lawsuit in the United States District Court for the Eastern District of Louisiana against Worley on behalf of himself and all other current and former claims adjusters/evaluators who worked for Worley on the BP Oil Spill.
The lawsuit (the Overtime Action) alleged that Altier and others similarly situated are owed unpaid overtime under the Fair Labor Standards Act (“FLSA”) as well as an additional equal amount of overtime as liquidated damages, attorneys’ fees and costs, and pre- and post-judgment interest.
On June 1, 2011, Altier filed a Second Amended Complaint in the Overtime Action joined by forty-five (45) additional plaintiffs (together, the “Named Plaintiffs”) who have asserted the same claims.
The Overtime Action is currently in the early pre-trial stages. Worley has denied Plaintiffs’ allegations and also deny any liability to Plaintiffs and other claims adjusters employed on the BP Project.
